Ich erkläre mich damit einverstanden, dass meine angegebenen Daten für die DSGVO-konforme Verarbeitung zum Zwecke der Erbringung der Hebammen-Dienstleistungen verarbeitet werden dürfen. Sofern noch keine Dienstleistungen erbracht wurden, kann diese Einwilligung jederzeit widerrufen werden. Wenn bereits Dienstleistungen erbracht wurden werden die Daten lediglich zum Nachweis der korrekten Abwicklung der bisherigen Tätigkeit (z.B.: Dokumentation der Hebammenleistung, Abrechnung der Hebammenleistung) verwendet. Durch den Widerruf der Einwilligung wird die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf verarbeiteten Daten nicht berührt.
Ihre Daten werden nach Ablauf der gesetzlichen Aufbewahrungspflichten für Dokumentation und Abrechnung (30 Jahre bei Hausgeburten, in allen anderen Fällen 10 Jahren) unwiderruflich gelöscht. Ihre Daten geben wir nicht ohne Ihre Einwilligung weiter - mit Ausnahme gesetzlicher Verpflichtungen wie der Abrechnung.
Ich verarbeite die Daten in Übereinstimmung mit den datenschutzrechtlichen Bestimmungen.
Ihnen stehen grundsätzlich die Rechte auf Auskunft, Berichtigung, Löschung, Einschränkung, Datenübertragbarkeit, Widerruf und Widerspruch zu. Wenn Sie glauben, dass die Verarbeitung Ihrer Daten gegen das Datenschutzrecht verstößt oder Ihre datenschutzrechtlichen Ansprüche sonst in einer Weise verletzt worden sind, können Sie sich bei der Aufsichtsbehörde beschweren.
Scope of application
The General Terms and Conditions of Contract apply to the contractual relationship between Myriam Rosenkränzer (midwife) and the service recipient. They become part of the contractual basis upon acceptance of the GTC.
Charges
The midwife will invoice the health insurance company directly for the fees for birth preparation and postnatal courses for women with statutory health insurance.
The health insurance companies (statutory/private) cover up to 14 hours of antenatal classes during each pregnancy and 10 hours of postnatal classes after the birth, provided the course is completed no later than 9 months after the birth.
The fees for missed classes are not covered by statutory health insurance and must therefore be paid by the participant herself in the amount of €15. The reason for non-attendance is irrelevant.
Private patients pay the fees for the entire course themselves. Private invoices from the midwife to self-pay patients must be paid within the agreed period, irrespective of the reimbursement period by the insurance company or subsidy office (§ 286 Para. 3 BGB).
Note: The numerous private health insurance tariffs differ considerably in terms of the scope of benefits and the amount of midwife assistance. Some inexpensive tariffs exclude midwifery assistance completely, others reimburse generously. The midwife has no knowledge of the content of the individual insurance tariffs.
Missed hours cannot be made up. The midwife is entitled to reschedule individual classes at short notice.
The partner fee for the birth preparation courses is a one-off amount, which can be seen in the course description and registration confirmation. It is to be paid in advance, further information can be found in the registration confirmation.
If the course is advertised as a partner course, the fee is payable regardless of the hours actually completed by the partner.
Some health insurance companies contribute to the partner fees for the course. Please contact your health insurance company for more information. You will receive a certificate of attendance at the end of the course.
Withdrawal from registration
Online registration is binding.
You can revoke your contractual declaration in text form (email to hebamme.rosenkraenzer@gmail.com) within two weeks without giving reasons. The period begins at the earliest with receipt of this instruction in text form and also not before fulfillment of our information obligations according to Art. 246 § 2 in connection with § 1 paragraph 1 and 2 EGBGB. The period ends at the latest fourteen days before the start of the course. Timely dispatch of the revocation is sufficient to comply with the revocation period.
If the course registration is more than 14 days in arrears at the time of withdrawal, the full course fee shall be due on termination of the course. Unless the course place can be filled at short notice via the waiting list. In this case, only a processing fee of €5 will be charged.
Participation in the booked course is governed by this contract. If individual questions and concerns are raised with the midwife outside of the course, these will be billed to the statutory health insurance fund/privately insured person in accordance with the midwife fee schedule.
For individual midwife care, a treatment contract applies which we conclude with each other. It is billed according to the midwife fee schedule. The contract will be discussed together in a first appointment and confirmed with your signature.
A separate treatment contract also applies to self-pay services, in which the details of the service and payment are set out.
Consumers are entitled to a right of withdrawal under the following conditions: A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity. The midwife/midwifery practice points out the following to the participant: You have the right to cancel this contract within 14 days without giving reasons. The cancellation period is 14 days from the day the contract is concluded. In order to exercise your right of withdrawal, you must inform the midwife of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or by email). In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.
Consequences of revocation
The midwife/midwifery practice must repay all payments received from the participant immediately, but at the latest within 14 days from the day on which notification of the revocation was received. If the participant has requested that the service begin during the cancellation period, she must pay the midwifery practice an appropriate amount that corresponds to the proportion of the service used up to that point.
